●     Non-molestation orders

This law is part of the family law application of 1996 section 42. The law is to put an end to harassment and abuse. Once the court is consulted, the Non-molestation order is set out in the terms needed to stop that molestation. The breach of this act is considered a criminal offence.

The following people can obtain a Non-molestation order in court if they feel unsafe or threatened in their own home:

●     An associated person

●     Cohabitant

●     Relevant child

This law is a type of injunction that may be sought by the victim of any domestic violence. The court will assess your evidence and will order the non-molestation law to protect you.

●     Occupation order

Occupation order is also covered in the Family Act of 1996; it is a short-term arrangement mostly (6-12 months). This law will specify the following things:

●     Who should live in the house

●     Who should be excluded from the house

●     Who should pay bills, mortgages, and rents of the house?

●     And who should be responsible for the maintenance of the property?

This law will specify areas in the house for each party to live. It will protect the property upon the demise of a partner/family member.

Who can apply for the order?

If you are a tenant or owner of the property or if you have any financial interest in the property; the court will consider every aspect of the above before issuing the Occupation order.

●     Injunction order

If you feel threatened or are being harassed by anyone around you such as a neighbour, ex-partner, or a family member, we can help you file an injunction application in court.

Injunction orders aim to protect against threats and harassment. This order comes under the Harassment Act 1997 or Family Act 1996. The processing of the order usually takes a week to two weeks. This order also provides protection against social services taking away your child.
